Due Diligence
Why should you do “Due Diligence” before decided to buy property in Thailand ?
I always suggest my clients to do a research of the land and property before signing any purchase contract. Having a Due Diligence on the Land title deed or Nor Sor Sam Kor is a good way to lower the risks of buying the land and property in Thailand. The land title search in Thailand is very important, if you are considering investing in property or building the house then you need to do a due diligence on the property you are wanting to buy.
🔴 What we do for due diligence report ?
-Investigate the land title deed (Is it a Por Bor Tor, Nor Sor 3, Nor Sor 3 Kor, Nor Sor 4 Jor, Chanotte, etc.) and its history (chain of possession, on back of some title deeds)
✔️ check the current owner and the owner right (To check if the owner is a legitimate owner to transfer the land to the buyer)
✔️check if there are any mortgages registered or any other incumbrances, lease, obligations, charges, claims, powers of attorney or any right registered against the land
✔️ check the building permit and any licenses.
✔️ check the land zoning with the Town Planing Office which means indicating type of the building allows and also the hight
✔️ check if the seller is previously or currently been involved in any court cases
✔️ check if there is a public or registered private road access to the land. What about servitudes?
✔️ Purchase price, taxes , and transfer fees
**All of this processes have to investigate with the government offices
Then the buyer or the tenant can make final decision later.
