How many types of land title deeds in Thailand?

Land title deed Nor Sor 4, Nor Sor 4 Jor (Red Garuda)

are the title deeds issued by the Land Department to certify the ownership of the land owner. Those who has a title deed in his/her possession, he or she has the absolute legal ownership of that piece of land.
– The Chanote title deed is the most valuable land document showing the ownership.
– Officially certified by government and the owner whose name is stated in the title deed can take full advantage of that land. He or she can also utilize, occupy, reside and make full use of it.
– The land owner has full legal rights for the purchase, sale, transfer, mortgage and guarantee.
– This type of land has the aerial photographs with accurate boundaries and locations.
– In term of the investment, the Land title deeds are considered to have the highest value among all types of the title deeds.
Caution:
1. The buyer and seller must register the transfer of the land ownership at the land office in the presence of the competent officials of the Land Office, otherwise it will be deemed void or invalid.
2. The right of the land ends after ten years of continuous hostile possession.

Land title deed Nor Sor 3 Kor (Green Garuda) 

Land title deed Nor Sor. 3 Kor (Green Garuda) is a certificate of utilization (Right of occupation). It is a title deed issued by the government to certify that the owner is entitled to legally utilize this plot of land.

– This type of land has the aerial photographs with accurate boundaries and locations.

– The land holder has the right to possess and use the land, buy, sell, and rent or expel intruders.

– Being allowed for purchase, sale, and transfer or bank mortgage.

– The land price with this type of title deed is often cheaper than the land with Chanote title deed but after the title deed Nor Sor 3 Kor was officially surveyed for accurate boundaries, the owner can then file a petition to upgrade it to Chanote title deed immediately without having to wait for a 30-day notice in public. The owner of this type of title deed often acquires the land at cheap price but when it is upgraded to a Chanote title deed, the price of the land will be much higher.

Caution:

– The legal right over the land with this type of title deed ends after being continuously occupied by others for 1 year.

Land Sor Por Kor. 4-01 (Red Garuda/Blue Garuda)

Land document Sor Por Kor. 4-01 (Red Garuda/Blue Garuda) is a land document that allows people to enter and use the land that is located in the land reform area for agriculture and the arrangement of housing in agricultural land. The owner has only the right of possession for agricultural purpose but has no ownership of the land and cannot upgrade it for the title deeds. The purchase, sale and transfer of the land to other people, other than their heirs, is prohibited. And the inherited land must be utilized for the agricultural purpose only.

– Used only for agriculture, cannot be used for other purposes.

– The occupiers of the land Sor Por Kor. 4-01 must be in poverty.

– Each family can occupy the land not exceeding 50 rai.

– Transferrable, dividable and inheritable within the family (according to the state’s regulations)

– Purchase and Sale are prohibited.

– Rentable but for agriculture only (according to the state’s regulations)

– Cannot be mortgaged, except for a government project that permits the use of the Sor Por Kor 4-01 document as a collateral.

– The appropriate buildings for the agricultural purpose are allowed.

– Can be returned to the state if the occupiers don’t want to use it any more.

– After stop doing agriculture, the occupiers have to return it to the state.

– Violation of state’s regulations, the land will be taken back to the state.

* Caution * Failure to comply with the regulations, the government can take it back.

Land title deed Nor Sor 3, Nor Sor 3 Khor (Black Garuda)

Land title deed Nor Sor 3, Nor Sor 3 Khor (Black Garuda) is a certificate of utilization (Right of occupation). It is a title deed issued by the government to general land occupiers.

– The land of this type of title deed has no aerial photographs. It only looks like a draft land map using the objects or trees in that area as a reference to outline the map. There is no accurate land position. In some areas, there is no aerial photographs.

The difference between Nor Sor 3 and Nor Sor 3 Khor is that the Nor Sor 3 is issued by local sheriff while the Nor Sor 3 Khor is issued by the land office, showing the right of occupation, but has not yet been officially certified.

When the land boundaries were accurately surveyed;

– The land holder has the right to possess the land for utilization, purchase, sale, and rent or expel intruders.

– Being allowed for purchase, sale, transfer or mortgage but the land must be surveyed and wait for a 30-day announcement from the government.

– Can be upgraded for a Chanote title deed at the land office where the land is located. The land officer will make an official survey and post a 30-day notice. If no one contests of such notice, then the issuance of the Chanote titled deed can be proceeded.

– The legal right over the land with this type of title deed ends after being continuously occupied by others for 1 year.
